Terms & Conditions

These Terms and Conditions ("Terms") govern your relationship with the online gambling services offered under the brand "kingbilly" via the website https://kingbillyz.com (the "Website"). By registering an account, depositing funds, or placing any bet, you confirm that you have read, understood, and agree to be bound by these Terms. These Terms take effect from 6 November 2025 and apply to all use of the Website and related services from that date onward.

Definitions

For the purposes of these Terms, the following definitions apply:

  • Operator means Dama N.V., a company registered under the laws of Curaçao (registration number 152125), having its registered address at Scharlooweg 39, Willemstad, Curaçao, which owns and operates the Website, and its subsidiary Friolion Ltd. to the extent it processes payments.
  • Website means the online gambling platform accessible at https://kingbillyz.com, including all sub-pages, content, and services.
  • Services means the online casino games, betting, account, payment, bonus, and ancillary services made available on or through the Website.
  • Account means a personal user account registered in your name on the Website, used to access the Services and hold your funds.

Account Registration

  • Australian players: The Website is operated offshore under a Curaçao licence (Antillephone N.V. licence no. 8048/JAZ2020-013). The Operator is not licensed in Australia. Under the Interactive Gambling Act 2001 (Cth), the Australian Communications and Media Authority (ACMA) may request that access to the Website be blocked. You are responsible for complying with Australian law and for any consequences of using offshore services.

Using VPNs or other tools to bypass such restrictions is strictly prohibited and may result in Account closure and forfeiture of winnings.

Registration Process and Verification

  • Account creation: To create an Account, you must provide a valid email address, choose a password, and supply any other requested information. You must verify your email address via the verification link sent by the Operator before full access is granted.
  • KYC documentation: The Operator may at any time require you to provide KYC documents, including (without limitation) a copy of your passport or ID card, proof of address, source-of-funds evidence, and copies of Payment Methods. Verification is mandatory before certain deposits, withdrawals, or cumulative transactional limits are reached.
  • Accuracy of data: You warrant that all information provided during registration and throughout your relationship with the Operator is true, complete, and up to date. You must promptly update your details if they change. The Operator may suspend or close your Account if any information is false, misleading, or incomplete.

Account Security and Use

  • Credentials: You are solely responsible for maintaining the confidentiality of your login credentials. Any activity carried out under your username and password is deemed to be performed by you. You must notify the Operator immediately if you suspect unauthorised access.
  • Single account: You may hold only one Account on the Website. Multiple Accounts, shared Accounts, or Accounts opened on behalf of another person are prohibited and may lead to closure of all related Accounts, cancellation of bets, and forfeiture of bonuses and winnings.
  • Responsible use: You may not use your Account for any unlawful purpose, including fraud, money laundering, or payment card abuse. The Operator and its payment processor, Friolion Ltd., may monitor transactions for AML purposes and report suspicious activity to relevant authorities.

Betting & Gameplay Rules

General Rules and Game Outcomes

  • Game rules: Each Game is governed by its own rules and paytables. In case of conflict between these Terms and any specific Game rules, the specific Game rules prevail for that Game. You must familiarise yourself with all relevant rules before placing bets.
  • Randomness and fairness: Outcomes of Games (other than live dealer games) are determined by a certified random number generator (RNG) provided by the Operator or its suppliers. The Operator endeavours to ensure that Games are fair, but makes no warranty that your participation will result in any particular outcome or winnings.
  • Bet confirmation: A Bet is accepted once it is recorded on the Operator's servers and reflected in your Account balance and Game session. If any discrepancy arises between your device display and the Operator's records, the Operator's records prevail.

Bet Placement, Limits, Errors, and Cancellations

  • Limits: Minimum and maximum bet limits are specified within each Game interface and may vary by Game, currency (including AUD), and Player status. The Operator may change limits at any time.
  • Irregular bets: The Operator may void or adjust bets that result from obvious technical or pricing errors, system malfunctions, or misconfigurations, including incorrect Game parameters, misapplied odds, or duplicate rounds. In such cases, affected transactions may be rolled back to the state prior to the error.
  • Cancellation: Once a Bet has been placed and accepted, you cannot cancel or modify it. The Operator may, in its sole discretion, cancel or refuse any Bet or series of Bets where required to comply with Applicable Law or to address suspected fraud or abuse.

Conduct, Collusion, and Prohibited Tools

  • Player conduct: You must not use offensive, abusive, racist, sexist, defamatory, or otherwise inappropriate language in chats, nicknames, or communications with other players or staff. The Operator may suspend chat access, lock your Account, or take other measures in response to misconduct.
  • Collusion and cheating: Any form of collusion, use of automated bots, scripts, or tools that provide an unfair advantage, exploitation of bugs, or manipulation of Games is strictly prohibited. The Operator may void related Bets, confiscate funds, and close Accounts involved in such conduct.
  • Live casino etiquette: You must follow the instructions of live dealers and staff, refrain from disrupting the Game, and respect other players. The Operator may remove you from a Game session, restrict access, or take further action in case of repeated or serious breaches.

Bonus Terms

Bonus Activation and Wagering Requirements

  • Activation: Bonuses may be credited automatically upon meeting eligibility criteria or may require a bonus code, opt-in, or explicit acceptance on the Website. Each Promotion is subject to its specific terms published on the Website, which you must read carefully.
  • Wagering: Unless stated otherwise, Bonus funds and associated winnings are subject to wagering requirements specified in the relevant Promotion, which must be completed within the stated timeframe (for example, within a certain number of days from crediting) in 2025. Until wagering is completed, Bonus funds are generally locked and cannot be withdrawn.
  • Contribution of Games: Different Games may contribute differently to wagering requirements, and some Games may be excluded. The Operator will publish contribution tables and excluded Game lists for each Promotion. Bets on excluded Games do not count towards wagering and may be treated as bonus abuse.

Betting Restrictions and Prohibited Practices

  • Maximum bet while wagering: The Operator may impose a maximum bet per spin, game round, or hand while Bonus wagering is active. Exceeding such limits may result in confiscation of Bonus funds and Bonus-related winnings.
  • Bonus abuse: Practices such as deliberately playing with low risk to unlock Bonuses, hedging bets, colluding with other players, creating multiple Accounts, or using a VPN to access restricted Promotions are treated as abuse. The Operator may remove Bonuses, forfeit winnings, and close implicated Accounts.
  • Combining Promotions: Unless explicitly allowed, Bonuses and Promotions cannot be combined or "stacked". Only one active wagering requirement may apply to your Account at any time. Cashback and loyalty rewards may have separate conditions.

Bonus Cancellation and Expiry

  • Cancellation: You may request that an active Bonus be cancelled, but you will lose any Bonus funds and Bonus-related winnings. The Operator may cancel Bonuses if technical or typographical errors have occurred.
  • Expiry: Bonuses and free spins generally expire after the period stated in the relevant Promotion (for example, a number of days from issue in 2025). Expired Bonuses and associated winnings are removed from your Account.

Payments & Withdrawals

Deposits

  • Payment Methods: Deposits may be made using supported Payment Methods, including cards, e-wallets, bank transfers, and, where offered, cryptocurrencies. The availability of methods depends on your jurisdiction, including for Players in Australia.
  • Ownership and legality: You may only use Payment Methods held in your own name and must ensure that deposits do not violate any laws applicable to you. The Operator and Friolion Ltd. may undertake checks and decline or reverse deposits where required by AML rules or card scheme regulations.
  • Fees and processing times: The Operator does not generally charge deposit fees, but your bank, card issuer, or wallet provider may. Deposits are usually processed instantly but may occasionally be delayed by third parties.

Withdrawals

  • Verification: The Operator may require full KYC verification before processing withdrawals, especially where cumulative deposits or withdrawals reach certain thresholds. Failure to provide requested documents may lead to withdrawal delays or cancellation.
  • Methods and limits: Withdrawals are, where possible, processed back to the same Payment Method used for deposit. Minimum and maximum limits per transaction, day, week, or month apply and are displayed on the Website. The Operator may split large withdrawals into instalments.
  • Processing times: Withdrawals are generally reviewed within a reasonable period after your request in 2025; however, actual receipt depends on third-party processors and may take additional time. The Operator is not liable for delays outside its control.

Currency, Chargebacks, and Refunds

  • Currency: The Website may support several currencies, including AUD for Australian Players. If your Payment Method operates in a different currency, your bank or provider may perform currency conversion at its own rates and fees.
  • Chargebacks: You agree not to request chargebacks or reversals without a valid legal basis. Unjustified chargebacks may result in Account suspension, recovery of funds, and reporting to relevant authorities and card schemes.
  • Refunds: As a general rule, stakes on completed Games are final and non-refundable. In cases of technical failure, obvious error, or Game malfunction, the Operator may, at its discretion, void the relevant Games and restore the Account balance to its state prior to the affected Bet or issue a refund of the stake.

Limitation of Liability

Operator's Obligations

  • Service provision: The Operator will provide the Services with reasonable skill and care, endeavouring to maintain a fair, secure, and reliable gambling environment and to comply with its Curaçao licence and other Applicable Law.
  • Game integrity: The Operator aims to ensure that Games operate as described and that outcomes are generated fairly, subject to regular testing by or on behalf of the Operator and its suppliers.

Exclusions and Limitations

  • No warranty of uninterrupted access: The Services are provided "as is" and "as available". The Operator does not guarantee that the Website will be uninterrupted, error free, or free from viruses or other harmful components.
  • Technical failures: The Operator is not liable for any loss resulting from failures of telecommunications, internet connectivity, hardware, software (including your device), or third-party systems beyond its reasonable control. In the event of a system failure affecting a Game, all Bets and payouts in that Game round may be voided and the stake returned.
  • Maximum liability: To the fullest extent permitted by Applicable Law, the Operator's total aggregate liability to you for any claim arising out of or in connection with the Services (whether in contract, tort, or otherwise) is limited to the lesser of: (a) the amount of your stake in the Bet or Game directly affected, or (b) the total amount of deposits you made to your Account during the 30 days immediately preceding the event giving rise to the claim.
  • Excluded losses: The Operator is not liable for indirect, incidental, consequential, special, or punitive damages, loss of profits, loss of opportunity, or alleged damages relating to legislative or regulatory action (including any ACMA blocking of the Website) except where such exclusion is prohibited by mandatory law.

Intellectual Property Rights

Ownership and Permitted Use

  • Content ownership: All intellectual property rights in the Website and Services, including but not limited to software, source code, databases, interfaces, artwork, graphics, logos, brand elements (including the "kingbilly" brand), text, audio, and video, are owned by the Operator, its group companies, or licensors.

Restrictions

  • Prohibited acts: You may not copy, reproduce, distribute, modify, decompile, reverse engineer, disassemble, translate, or create derivative works from any part of the Website or Services, except as expressly permitted by law.
  • No commercial use: You may not use any part of the Website, Services, or content for commercial purposes without the prior written consent of the Operator.
  • Trademarks: You may not use any trademarks, trade names, or logos displayed on the Website (including the "kingbilly" brand) without prior written consent, and you may not register any domain names or social media accounts that include or imitate such marks.

Privacy & Data Protection

Your Personal Data is collected and processed by the Operator in accordance with its Privacy Policy, which forms an integral part of these Terms and is available at https://kingbillyz.com/privacy-policy. By using the Services in 2025, you acknowledge that:

  • Processing purposes: Your Personal Data may be processed for account management, KYC and AML checks, payment processing (including by Friolion Ltd.), responsible gambling monitoring, prevention of fraud, and compliance with legal and regulatory obligations.
  • International transfers: Your Personal Data may be transferred to and processed in Curaçao, Cyprus, and other jurisdictions where the Operator's service providers are located, which may have data protection laws different from those of your country, including Australia.
  • Player rights: Subject to Applicable Law, you may have rights to access, correct, or delete your Personal Data, or to object to certain processing. Details of how to exercise such rights are set out in the Privacy Policy.

Changes to Terms

Updates and Notification

  • Right to amend: The Operator may modify these Terms at any time in 2025 to reflect changes in the law, regulatory guidance (including from ACMA and Curaçao authorities), technical developments, or business needs.
  • Notice: Material changes will be notified by reasonable means, which may include email, on-site notifications, banners, or prompts when you next log in. Revised Terms will be published on the Website with an updated effective date.

Acceptance of Changes

  • Continued use: If you continue to use the Services after changes to the Terms become effective, you are deemed to have accepted the updated Terms.
  • Right to discontinue: If you do not agree with the updated Terms, you must stop using the Services and may request closure of your Account and withdrawal of any available real-money balance, subject to verification and these Terms.

Termination & Suspension

Grounds for Suspension or Closure

  • Breach and risk: The Operator may suspend or terminate your Account where it reasonably believes that you have breached these Terms, engaged in fraud, bonus abuse, money laundering, chargebacks, or other unlawful activity, or pose a regulatory or reputational risk.
  • Legal and regulatory requirements: The Operator may suspend or close your Account if required by law, court order, regulatory instruction (including any request from ACMA or Curaçao regulators), or if the Website is blocked or restricted in your jurisdiction.
  • Inactive accounts and self-exclusion: The Operator may treat Accounts as inactive after a period of no logins and apply its inactive-account policy as set out on the Website. If you self-exclude, your Account will be suspended in accordance with responsible gambling procedures.

Consequences of Termination

  • Balance handling: On termination, any remaining real-money balance, subject to KYC and AML checks and any lawful rights of set-off, will generally be returned to you via an appropriate Payment Method. Bonus funds and Bonus-related winnings may be cancelled in accordance with the Bonus Terms.
  • Forfeiture: Where termination results from serious breach, fraud, or unlawful activity, the Operator may void Bets, confiscate funds related to such activity, and withhold payouts to the extent permitted by Applicable Law and necessary to comply with legal obligations.
  • Notification: The Operator will use reasonable efforts to notify you of suspension or closure via the email address registered on your Account, unless prohibited by law or regulatory instruction.

Governing Law & Jurisdiction

Applicable Law

  • Primary governing law: These Terms and your relationship with the Operator are governed by the laws of Curaçao, excluding conflict-of-law rules that would result in the application of the laws of another jurisdiction.
  • Mandatory local rights: Nothing in these Terms affects any mandatory legal rights you may have under the laws of your country of residence, including Australian consumer protection laws, to the extent such rights cannot be excluded by agreement.

Dispute Resolution

  • Internal complaints: If you wish to raise a complaint, you must first contact customer support at [email protected], providing full details and supporting evidence. The Operator will investigate and respond within a reasonable time.
  • External escalation: If your complaint is not resolved to your satisfaction, you may escalate the matter to the designated alternative dispute resolution (ADR) body or to the relevant licensing authority (Antillephone N.V. on behalf of the Government of Curaçao), as indicated on the Website.
  • Courts of Curaçao: Subject to any ADR process and any non-excludable rights to bring proceedings in another jurisdiction, any dispute arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the competent courts of Curaçao.
